AmeriWay Terms of Use

Effective date: November 2, 2026

These terms are an agreement between you and AmeriWay Technologies LLC ("AmeriWay", "we", "us") about your use of the AmeriWay app and service. By installing or using AmeriWay you accept them. If you do not accept them, do not use the app.

1. Who may use AmeriWay

You must be at least 13 years old. If you are under 18, a parent or guardian must agree to these terms for you.

2. What AmeriWay is, and what it is not

AmeriWay translates speech, screen text and the sound of videos by machine. Machine translation makes mistakes: it can mishear words, miss a name, choose the wrong meaning or the wrong grammatical gender, and it can lag behind the speaker.

AmeriWay is not a certified or qualified interpreter. Do not rely on it alone for:

  • medical care, medicines or consent to treatment;
  • legal matters, court, police, immigration interviews or signing documents;
  • emergencies or safety decisions;
  • money decisions you cannot undo.

In those situations, ask for a qualified interpreter. Hospitals, courts and many government offices must provide one, often free.

3. Your license to use the app

We give you a personal, non-exclusive, non-transferable, revocable license to install and use the app on devices you own or control, under these terms and the rules of the app store you got it from.

You may not, and may not help others to:

  • copy, modify, or make works based on the app or our service;
  • reverse engineer, decompile or disassemble the app, or try to extract its source code, models, prompts or term lists, except where the law allows it despite this term;
  • access our servers other than through the app, or scrape, overload or probe them;
  • get around usage limits, subscriptions or security;
  • resell, rent or share access to the paid service outside your family plan;
  • use AmeriWay to record, listen to or translate people in breach of the law, or to harass, threaten or deceive anyone;
  • use AmeriWay to break any law or anyone's rights.

4. People around you

AmeriWay hears the people near you while Listening is on, and speaks translations aloud if you allow it. AmeriWay does not record or store sound. Laws about listening to conversations differ from place to place; you are responsible for following them, and for telling people when you are using a translator where that is required or polite.

5. Content you translate

You keep whatever rights you have in what you translate. You give us permission to process it only to provide the translation to you, as described in our Privacy Policy. Make sure you have the right to use the screens, videos and other content you translate.

6. Free and paid plans

6.1 The free plan works on your phone and may have fewer features and lower quality.

6.2 Paid plans are sold through Google Play or the Apple App Store as subscriptions that renew automatically until you cancel. Prices, billing and refunds follow the store's rules. You cancel in the store's subscription settings; the plan stays active until the end of the period you paid for.

6.3 Each paid plan includes minutes of translation on our servers each calendar month (UTC): Pro 600 minutes; Family 1,500 minutes shared by the account owner and up to 4 family members; the first-month offer 150 minutes. Unused minutes do not carry over. When the month's minutes are used, translation on our servers stops until the next month begins. Translation on your phone still works, and you may change your plan in the app.

6.4 We may change prices for future periods. The store tells you before a higher price applies, and you may cancel.

7. Changes to the service

We improve AmeriWay often. We may add, change or remove features. If we stop the paid service entirely, we stop charging for it.

8. Ownership

AmeriWay, its logo, the app, our servers, models, prompts, term lists and everything else we provide belong to AmeriWay Technologies LLC or its licensors and are protected by law. These terms give you no rights in them except the license in section 3. Parts of the app are open-source software, used under their own licenses, listed in the app.

If you send us ideas or feedback, we may use them without paying you or owing you anything.

9. Ending use

You may stop using AmeriWay at any time. We may suspend or end your access if you break these terms or if we must do so by law. Sections 2, 3 (the restrictions), 8, 10, 11, 12 and 13 continue after your access ends.

10. No warranties

AmeriWay is provided "as is" and "as available". To the extent the law allows, we make no warranties of any kind, express or implied, including that translations are accurate or complete, that the service is uninterrupted, or that it fits a particular purpose. Some places do not allow these exclusions, so some may not apply to you.

11. Limit of liability

To the extent the law allows, AmeriWay and its member, officers and providers are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or opportunities, arising from your use of AmeriWay or from any translation. Our total liability for any claim about AmeriWay is limited to the greater of the amount you paid us in the 12 months before the claim, or $50. These limits do not apply where the law forbids them.

12. Your responsibility to us

If someone makes a claim against AmeriWay because you broke these terms or the law while using AmeriWay, you will cover our reasonable costs of that claim, to the extent the law allows.

13. Law and disputes

These terms are governed by the laws of the State of Michigan and of the United States, without regard to conflict-of-law rules.

Before starting any claim, please write to us so we can try to solve it; we will reply within 30 days.

Any dispute is decided by the state or federal courts located in Michigan, and you and we accept their jurisdiction. Either of us may bring a claim in small claims court where it qualifies.

14. App stores

If you got AmeriWay from the Apple App Store, these terms are between you and AmeriWay, not Apple; Apple is not responsible for the app or its support; Apple has no warranty duty beyond refunding the purchase price where the store's rules provide it; Apple is not responsible for claims about the app, including product liability, legal or regulatory claims, or intellectual property claims; and Apple and its subsidiaries may enforce these terms against you as a third-party beneficiary. You confirm you are not in a country under U.S. embargo and are not on a U.S. government list of prohibited or restricted parties. If you got AmeriWay from Google Play, Google Play's terms also apply to your purchase.

15. General

If any part of these terms cannot be enforced, the rest stays in effect. If we do not enforce a term, we do not give up the right to enforce it later. You may not transfer these terms; we may transfer them to a company that takes over AmeriWay. We may change these terms; we tell you in the app before a change that matters takes effect, and the new terms apply from the date shown.

These terms are written in English. The Ukrainian and Russian versions are translations for your convenience. If they differ, the English version controls.
